The goal of this work is to present the historical and legal constitution of the internship in the teacher training and education. It appoints as a specific point the non-mandatory paid internship, understood as an extracurricular component in graduation courses and with a strong focus on the social practice. It highlights the constitution of the internships in the context of industrialization and modernization of Brazilian society and the main legal frameworks resulting from educational reforms. Based on documentary research it makes use of a critical-dialectical approach and analyzes the legal provisions related to internships and the relation with the teacher training, education and work highlighting the internship dimension as an act of education and work. It shows that the non-mandatory paid internship, as a theoretical-practical dimension, is fundamental to the formative-educational process, nonetheless, it may become exploitation of the trainees' workforce when the necessary requirements for monitoring are not observed, planning and development of activities related to the internship in educational institutions.
